Bus Driver Sued After Attacking Teenager For Being Short On Fare

A ballistic bus driver attacked a Bronx high-school student as she fled a tirade of insults for coming up short on her bus fare, a lawsuit claims.

Yelenys Soto, who was 15 at the time, felt sick when she boarded the BX2 near Clinton HS at around 11:20 a.m. Nov. 25, 2009. She realized she had misplaced her MetroCard and told the driver she was $1.25 short.

A passenger offered to pay her fare, but driver Rafael Rivera, 48, told her to “just get in and sit down.”

According to the suit, filed Monday in Bronx Supreme Court, Rivera was abusive toward her while he was driving and followed her off the bus, grabbed her by the throat and shoved her into a black metal gate.

An MTA source told The Post that Rivera had been fired because of what happened.

The MTA refused to comment. Rivera could not be reached for comment.
